EULA - End User License Agreement

END USER LICENSE AGREEMENT

PLEASE READ THE FOLLOWING LICENSE CAREFULLY BEFORE INSTALLING.
By installing and using KoolWeather, ('the Software Product') you agree to the following agreement between you and the ('licensor of the Software'), Barry W. Andrews.
The Licensee ('you' or 'your') license to download, use, copy, or change the Software Product is subject to these rights and to all the terms and conditions
of this End User License Agreement ('Agreement').

1. Acceptance.
YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY SELECTING THE 'I Agree' OPTION, INSTALLING, USING, OR COPYING THE SOFTWARE PRODUCT.
YOU MUST AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT BEFORE INSTALLING, USING, OR COPYING THE SOFTWARE PRODUCT.
IF YOU DO NOT AGREE, YOU MUST SELECT the 'Cancel' OPTION AND YOU MUST NOT INSTALL, USE, OR COPY THE SOFTWARE PRODUCT.

2. License and Restrictions.
You may use the Software Product on your personal computer or a computer of which you are the primary user. The Software Product is copyrighted by the licensor of the Software Product. You may copy the Software Product for back-up purposes only. You must cause all copyright and other proprietary rights notices contained in or affixed to the Software Product to be reproduced or applied, as applicable, and maintained on any copy of the Software Product. You shall not modify, decompile, disassemble, decrypt, extract, or otherwise reverse engineer the Software Product. Except for the limited right specified above, the Software Product may not be copied in any other manner. The Software Product may not be transferred, leased, assigned, or sublicensed, in whole or in part. The Software Product remains the property of the licensor of the Software. You may terminate this License at any time by destroying all copies of the Software Product.

3. No Warranty.
You are solely responsible for the installation and use of the Software Product and for achieving your intended results. The Software Product is provided 'AS IS,' and AS AVAILABLE, without a warranty of any kind. ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, ARE HEREBY EXCLUDED.

4. Limitation of Liability.
IN NO EVENT SHALL THE LICENSOR OF THE SOFTWARE PRODUCT OR HIS AFFILIATES BE LIABLE FOR ANY LOST REVENUE, PROFIT OR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, PERSONAL INJURY, SICKNESS, OR DEATH, HOWEVER CAUSED AND REGARDLESS OF THEORY OF LIABILITY, ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF THE LICENSOR OF THE SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5. Indemnification.
You agree to indemnify and hold licensor of the Software, his affiliates, licensors, licensees, content providers, employees and agents harmless from any liabilities, claims and expenses, including reasonable attorneys fees, caused by or arising out of any breach of this License. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS. IF YOU DISAGREE, YOU MUST REMOVE THE SOFTWARE PRODUCT FROM YOUR COMPUTER.
